Seeking Appellate Counsel for
California Capital Cases

Join us in upholding justice!

The California Supreme Court is seeking qualified attorneys to accept appointment in capital appeals. These cases represent some of the most complex, consequential, and intellectually demanding work in the criminal legal system—and offer a chance to make a meaningful contribution to justice in California.

Challenging, Engaging, and Professionally Rewarding

Appellate counsel in capital cases handle intricate records, high-stakes constitutional issues, and novel legal questions. Many attorneys describe this work as among the most rigorous and rewarding of their careers:

“There’s real intellectual joy in coming up with an idea where there was no idea before.”
“It’s harder, more complex, and more engrossing than non-capital appeals—everything is interconnected.”

Making a Difference in a Dynamic Legal Landscape

Recent reforms such as the Racial Justice Act, Penal Code § 1172.1, SB 1437, and AB 333 have expanded the legal landscape and opened new avenues for relief. For lawyers who enjoy deep analysis, persuasive writing, and strategic advocacy, capital appeals offer a uniquely challenging arena.

Expert, Hands-On Support from CAP–SF

Appointed counsel do not work in isolation. The California Appellate Project – San Francisco (CAP–SF) provides individualized consultation and expert support at every stage—from record correction through briefing, oral argument, and post-judgment proceedings. CAP–SF attorneys work closely with appointed counsel to help:

  • Identify and remedy record deficiencies.
  • Develop and refine case strategy and legal issues.
  • Review and strengthen draft briefs and motions.
  • Prepare for oral argument through moot courts and focused strategy sessions.
  • Navigate post-judgment procedures and evolving case law.

Attorneys also gain access to comprehensive resources, including the Capital Post-Conviction Representation Manual, extensive sample pleadings, a legal update service, and ongoing training programs. CAP-SF’s experienced staff are available for consultation at every step.

“CAP supervision ups my game—it makes me think harder and deeper.”
“While you’re hands-off on a brief, someone else is helping make it better.”

Independent Work, Supported Practice

Many appointed counsel value the ability to work independently and manage their own schedules while knowing expert support is available:

“This lets me do work I believe in that fits with my lifestyle.”
“I like being my own boss and setting my own schedule.”

Qualifications and Compensation

Substantial appellate experience is required, but prior capital experience is not. Counsel must demonstrate strong analytical, writing, and case-management skills and a commitment to careful, ethical advocacy.

A $10-per-hour increase in compensation for appointed capital counsel was approved in the current state budget.
